Terms of service
Article 1: Purpose
The purpose of these Terms and Conditions is to define the terms, conditions, rights, and obligations of Secondtrack Co., Ltd. (“Secondtrack”) and users (“Users”) with respect to the use of the services provided through Secondtrack’s website and platforms (“Services”).
Article 2: Definitions
The following terms are used in these Terms and Conditions:
1. User: An individual who accesses and uses the Services provided by Secondtrack.
2. Member: A User who has registered an account with Secondtrack and agreed to these Terms and Conditions.
3. ID: A unique identifier used to recognize a Member.
4. Password: A secure string of characters set by the Member for account verification and protection.
5. Operator: Secondtrack Co., Ltd., which operates the platform and provides Services.
6. Content: Includes but is not limited to audio recordings, visual assets, text, graphics, and media related to vinyl records and other materials provided on the platform.
Article 3: Acceptance of Terms
1. By accessing or using Secondtrack’s Services, Users agree to comply with these Terms and Conditions.
2. Members must indicate acceptance of these Terms and Conditions by clicking “I Agree” during the account registration process.
Article 4: Membership Registration
1. Users must provide accurate and complete information during registration, including a valid email address, to become a Member.
2. Members are responsible for safeguarding their login credentials. Secondtrack is not responsible for unauthorized access caused by a User’s failure to protect their account information.
Article 5: Privacy Policy
1. Secondtrack values and respects the privacy of its Users. All personal information collected during registration and use of the platform will be handled in accordance with Secondtrack’s Privacy Policy.
2. Secondtrack shall not be liable for any personal information leaked due to circumstances beyond its control, such as hacking or other cyber threats.
Article 6: Service Use
1. Secondtrack’s Services are available 24/7, except during maintenance, upgrades, or unforeseen interruptions. Announcements regarding scheduled maintenance will be posted on the platform.
2. Secondtrack reserves the right to modify, suspend, or terminate any aspect of the Services at any time without prior notice.
3. All products sold by Secondtrack, including but not limited to vinyl records and merchandise, are official releases authorized by the respective rights holders. Secondtrack guarantees the authenticity and quality of all its offerings.
Article 7: Damaged Packages
1. All vinyl records and merchandise sold by Secondtrack are carefully packaged using secure materials to minimize the risk of damage during transit.
2. However, due to the nature of international shipping, minor cosmetic damage—such as corner dings, creases, or surface wear to outer sleeves made of paper or cardboard—may occur.
3. These forms of damage do not affect the functionality or playback quality of the record and are not considered valid grounds for return, refund, or exchange.
4. By placing an order, the buyer acknowledges and accepts the inherent risks of international shipment and agrees that Secondtrack is not responsible for cosmetic damage to packaging that occurs in transit.
Article 8: Stolen or Missing Packages
1. All orders placed through Secondtrack are shipped via reliable, trackable services such as DHL, EMS, or equivalent carriers.
2. Once an order has been marked as “delivered” by the carrier, responsibility for the package transfers to the buyer.
3. It is the buyer’s responsibility to ensure that the shipping address provided is secure and accessible for delivery.
4. Secondtrack is not liable for stolen, lost, or misdelivered packages that have been confirmed as delivered by the carrier.
5. In cases of suspected theft, customers are encouraged to file a claim with the carrier and/or local authorities.
6. While Secondtrack will provide all necessary documentation to support such claims, replacement or reshipment is not guaranteed.
Article 9: Order Cancellation Rights
1. Secondtrack reserves the right to cancel any order at its sole discretion in cases where a User violates these Terms and Conditions or any additional policies set by Secondtrack.
2. Orders may be cancelled under, but are not limited to, the following circumstances:
• Exceeding the purchase limits established by Secondtrack (e.g., multiple purchases of the same item by a single customer in violation of stated limits).
• Providing false, misleading, or incomplete information during registration or checkout.
• Unauthorized reselling or distribution of Secondtrack products.
• Inappropriate behavior toward Secondtrack staff or the community.
3. In such cases, Secondtrack may cancel all current and future orders associated with the individual(s) in violation of these terms.
4. Canceled orders under this policy will not be eligible for reinstatement or appeal unless otherwise determined by Secondtrack.
Article 10: User Obligations
1. Users shall not engage in any activity that disrupts the operation of Secondtrack’s platform or infringes on the rights of others, including intellectual property rights.
2. Users may not use the platform for unauthorized commercial purposes or redistribute content without explicit permission from Secondtrack.
3. Users must not upload, post, or share any content that violates laws or public morals, including defamatory, obscene, or infringing materials.
Article 11: Intellectual Property Rights
1. All content on the platform, including but not limited to designs, text, graphics, and audio recordings, are owned or licensed by Secondtrack. Unauthorized use, reproduction, or distribution is strictly prohibited.
2. Users retain ownership of any original content they upload to the platform but grant Secondtrack a non-exclusive, royalty-free license to use, display, and distribute such content for non-commercial purposes.
Article 12: Product Authenticity
1. All products sold by Secondtrack are official releases, produced and distributed with the authorization of the respective rights holders.
2. Secondtrack ensures the authenticity, quality, and adherence to licensing agreements for all its products.
3. Any unauthorized resale, reproduction, or distribution of Secondtrack’s products is strictly prohibited and may result in legal action.
Article 13: Limitations of Liability
1. Secondtrack is not responsible for any damages or losses arising from the misuse of its platform or Services by Users.
2. Secondtrack shall not be liable for delays, interruptions, or failures in performance caused by circumstances beyond its reasonable control, including natural disasters, cyber-attacks, or third-party failures.
3. Secondtrack does not guarantee uninterrupted availability of the platform or its content.
Article 14: Termination of Membership
1. Members may terminate their membership at any time by submitting a request through the platform’s account settings.
2. Secondtrack reserves the right to suspend or terminate membership if a Member violates these Terms and Conditions or engages in prohibited conduct.
Article 15: Content Management
1. Secondtrack reserves the right to monitor, review, and remove any content uploaded by Users that violates these Terms and Conditions or relevant laws.
2. Users are solely responsible for the content they upload and may be held liable for damages caused by infringing or unlawful materials.
Article 16: Amendments to Terms
1. Secondtrack reserves the right to amend these Terms and Conditions at any time.
2. Any changes will be announced via the platform, and continued use of the Services constitutes acceptance of the updated Terms.
Article 17: Governing Law and Jurisdiction
1. These Terms and Conditions are governed by the laws of the Republic of Korea.
2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.

These Terms and Conditions are effective as of November 11, 2024.
